EA Faces lawsuit over Spore DRM

Written on: September 24, 2008 by xDreamache

Spore DRM is now cause for a class action lawsuit against EA. From Gamepolitics.com - "

Electronic Arts, a leading maker of computer games, defrauds consumers through its "Spore" game, which "completely wipes their hard drive" and replaces it with an undisclosed program that prevents the computer from operating under some circumstances and disrupts hardware operations, a class action claims in Federal Court.

The class claims that "Spore," a virtual reality simulation game, contains "a second, undisclosed program" called SecuROM, a "form of Digital Rights Management (DRM) for computer games."

Consumers are not warned about the program, which is installed without notice and cannot be uninstalled, even if the uninstall Spore, the complaint states. The secret SecuROM program is "secretly installed to the command and control center of the computer (Ring 0, or the Kernel), and surreptitiously operated, overseeing function and operation on the computer, preventing the computer from operating under certain circumstances and/or disrupting hardware operations," the complaint states."

I'm not saying they shouldn't protect their games, it's just that their protection is near worthless. Stardock's games have no protection at all and they have very respectable profits for a company of their size (Not to mention excellent games). I'm just saying EA deserves this. Why? Well, old grudge against EA, they bought some superb game producers and from that point, some of the producers, go to shit (Such as Origin). They either can't meet EA's asinine deadlines or they manage to meet them but rush their games and as a result the quality of the games drops. It's not about the poor employees it's about profit.

I looked on that website and all of those problems are on earlier versions of a pc (or mac) and are problems with earlier versions of SecuRom. For example, 3rd picture down, it literally says,"If you have not intetionally started the program above...", the program being a version of Sims 2. The user did start it so there should be no problem. Plus, understand where EA is coming from. Would you want a game that was worked hard on by not only your employees but other companies, pirated millions of times?

Yes, now that is a more reasonable argument. Personally I haven't had any problems with Securom, so I can't say anything about it slowing or not a system, because different configurations convey different results. However the fact that it's inefficient as an anti-piracy tool and still causes some irritating errors and interferences that piss off some people. I haven't had any of these problems, and neither do have I seen any hard proof that securom slows down your system. So I'll call it unconfirmed. But the following are actually caused by Securom: http://reclaimyourgame.com/index.php?option=com_content&view=article&id=52&Itemid=13 Don't get me wrong, I'm not for raping Securoms family and killing it slowly like some people would prefer, but I'm just saying that it's inefficient. However I am glad that EA got this, because they generally ignore technical problems and their users.

sorroy there, the bit about helping your system is wrong, the site wasnt referable. the bit about your hard drive being crowded is correct however. since everyone has a slighty different computer (different files programs etc) drm effects each computer differently. there has beend some talk about a patch ea might issue but i cant say anything for sure. also for those of you who "just got a brand spankin new expensive computer," none of these issue can hurt your privacy, only your pirating(cmon you really ea wants to spy on you?)

Joe: DRM/Securom does NOTHING to combat spyware. Overgeneralising that all people who bitch about Securom slowing their system down have their hard drive full is not the way to go. Securom doesn't help your computer with anything. Securom help EA: Securom is simply a program that tries to prevent software piracy and does so through methods some people do not agree with at all. Please, present any credible source that supports your comment that Securom helps your system.

wow u guys are unbelievable...SecurROM and DRM help your system. Those programs stopped unwanted spyware and popup ads that find their way to your computer from the online information you put in the game. Also, if your system runs slow, then it means your hard drive is full or you have invisible programs such as DRM trying to combat spyware since your system is filled with it. Trust me.

K like i havent gotten "a second, undisclosed program" on my computer as far as i know, so i'm just going to say thet the program was from somthing else(just spitballling here) Second and this is to sagelund, know im not sure but is maxis not a part of ea. I'm pretty sure that maxis is a "division of ea" but im not sure. k thats all

How come I find you, and your highly negative comments, on every news article, all dated October 10, MatchNL?

9. MatchNL - Oct 10, 2008 09:35 PM

I waited so long for this game, and it SUCKED. IT SUCKED... IT SUCKED... IT SUCKED. DRM or not. The game is f**king BORING.

10. sagelund - Oct 07, 2008 11:01 PM

YAY! EA is suffering! I never really liked them. Maxis was always better. Ea was cut down to size and im glad!

11. Calandrinon - Oct 06, 2008 05:48 AM

While I agree EA deserves this, because they do, Securom while a pain in the ass and simply wrong isn't as satanic as it seems. Securom can be uninstalled using an uninstaller provided by its producer but will work only if all games using securom are also uninstalled (Because any Securom file deleted is rebuilt by the game). However there is discussion if the uninstaller leaves any hidden files or hidden registries. http://www.simprograms.com/?p=658

I dislike DRM as much as the next guy, but installing Spore has had no ill effects on my computer. Spore did refuse to start once recently because I wasn't connected to the Internet (probably because of the patch), but I've been fine with it otherwise.

13. bnbnbpk2 - Oct 02, 2008 07:51 PM

hahahahaha! yes! EA 0 the law 1 soon EA will lose and eating its way out of its ruin will be the great proud and most importantly SecROM FREE Maxis! Boo ya! i predict at least 3 more lawsuits for the same thing in the next year. any one wanna bet?

14. xMasterOfGamez - Sep 30, 2008 01:02 PM

Well, the performance of my system is plagued now. It's slower than normal and I really truly wish EA went bankrupt. I also wish maxis could become huge and break off from EA.

15. phindol900 - Sep 27, 2008 06:14 AM

i have a question though.... couldnt you back up your harddrive? like all your documents and stuff except for the securom then just wipe it and then put everything back?

16. mastergamer2008 - Sep 27, 2008 01:53 AM

i belive that EA should send out a cd to all people who insalled spore and had to install DRM, that takes it off your sysyem if the costomer wants. Or they should pay like $1500 USD at least so that everyone can buy a new computer. That would show them to never put up false information and to even make that software in the first place.

17. Splitfish - Sep 26, 2008 06:26 PM

what sort of stuff does it prevent from running, can i get some examples please?

18. DarkNeon - Sep 26, 2008 05:11 PM

Wow, Either AVG works a lot better then I thought, or everyone else is lying. I'm going with number 2.

19. Spork - Sep 26, 2008 04:43 PM

If you read the lawsuit, it stays that the user would have to wipe their hard drive to get rid of the secur-rom, not that the secur-rom its self will wipe the hard drive.

20. vetrijar - Sep 25, 2008 05:36 PM

otherwise (still itching ears) curious on the lawsuit. What is this "completely wipes hard drive" issue? as in the DRM is formatted computers spontaneously and putting a "you've been spanked" kind of message on the computer?? Or just a metaphor in saying that an unauthorized program is playing big daddy?

21. vetrijar - Sep 25, 2008 05:32 PM

OOUCH, my ears were burning... actually would take a while to find but, I believe it was sometime repeated between Nov-March this year during all the delay questions. BUT otherwise, EA mentions similarities in their article about how the drm would work with spore in the authentications for additionally bought content (basically an expansion) with spore. here's that June 08 article in 2nd paragraph, http://arstechnica.com/journals/thumbs.ars/2008/06/20/spore-creature-creator-drm-explained-direct-from-ea

22. lucky711 - Sep 25, 2008 04:39 PM

vetrijar!!!!!!!!!!!! member the comment i made on the article about the Spore patch, and i was saying that i heard about no more expansion packs, that there will be just updates now, WHERE DID YOU READ THAT!!! B/c i saw it a long time ago and don't member where and my friend that went to the EA studios needs a link to a site that mentions that, some "people" need to see that information! PLEASE, can you post the link on the "1 million" article on the site! And if anybody else has read it, please post their link too, to that same article on here!! THANK YOU!!

23. eueueu - Sep 25, 2008 04:33 PM

EA really sucks, they are one of the worst and most unethical companies I know.

24. lucky711 - Sep 25, 2008 04:26 PM
